Can I use Direct Access for my visa application?

Direct Access Barristers handle tribunal appeals, not initial visa applications. If the Home Office has refused your visa and you want to appeal, a Barrister can represent you at the First-tier Tribunal. For initial applications, you would typically need an immigration Solicitor or advisor to prepare and submit the application on your behalf.

How quickly can I get a Barrister after my refusal?

However, immigration appeals often have strict time limits, typically 14 days from the date of the Home Office decision for in-country appeals. It's crucial to act quickly. Submit your case as soon as you receive your refusal letter so we can find you representation before the deadline.

What if I cannot afford private fees?

If you cannot afford private legal fees, you may be eligible for legal aid. Legal aid is available for certain immigration cases, particularly asylum claims and cases involving victims of trafficking. However, legal aid cases must be handled by a Solicitor, you cannot use Direct Access with legal aid. Your Barrister can advise you on whether legal aid might be available and point you towards appropriate Solicitors if needed.

Can my Barrister attend tribunal remotely?

Yes. Since the pandemic, the First-tier Tribunal (Immigration and Asylum Chamber) regularly conducts hearings by video link. Your Barrister can represent you remotely in many cases. However, some hearings are still held in person, and there may be strategic advantages to attending in person. Your Barrister will advise on the best approach for your specific case.

What are my chances of winning my appeal?

Success rates vary significantly depending on the type of case, the strength of your evidence, and the grounds of appeal. What happens if I lose at First-tier Tribunal?

If your appeal is dismissed at the First-tier Tribunal, you may be able to apply for permission to appeal to the Upper Tribunal. This is only possible if the First-tier Tribunal made an error of law, you cannot simply re-argue the facts. Your Barrister can advise whether there are grounds to appeal further. The time limit for applying for permission is usually 14 days from the date you receive the decision.

Do I need an interpreter?

If English is not your first language, the tribunal will provide an interpreter free of charge for your hearing. You should specify the language and dialect you need when filing your appeal.
